This Privacy Policy explains how Brewhackers Technologies Private Limited (collectively ‘Pondr’, ‘we’ or ‘us’) collects, uses, and discloses information about you. This Privacy Policy applies when you use our website, mobile application, and services that link to this Privacy Policy (collectively, our “Services”), contact our customer service team, engage with us on social media, or otherwise interact with us.

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy and, in some cases, we may provide you with additional notice (such as adding a statement to our website or providing you with a notification). COLLECTION OF INFORMATION

We collect information you provide directly to us. For example, you share information directly with us when you create an account, fill out a form, submit or post content through our Services, communicate with us via third-party platforms, request customer support, or otherwise communicate with us. The types of personal information we may collect include your name, username, bio, email address, business information, your content, including your profile photo, photos, posts, responses by you, and any other information you choose to provide.

DERIVATION OF INFORMATION

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your location based on your IP address or infer reading preferences based on your reading history.

We use the information we collect to provide, maintain, and improve our Services, which includes publishing user-generated content and personalizing the posts you see. We also use the information we collect to:

  1. Create and maintain your Pondr account;
  2. To provide the services we offer on the Pondr and make it available to the public, communicate with you about your use of Pondr, respond to your inquiries, provide troubleshooting, and for other customer service purposes.
  3. Send you technical notices, security alerts, and support and administrative messages;
  4. Respond to your comments and questions and provide customer service;
  5. Communicate with you about new content, products, services, and features offered by Pondr and provide other news and information we think will interest you Monitor and analyze trends, usage, and activities in connection with our Services;
  6. Detect, investigate, and prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity, situations involving potential threats to the safety of any person or violations of our Terms of Service or this Privacy Policy and to protect the rights and property of Pondr and others;
  7. Debug to identify and repair errors in our Services;
  8. Carry out any other purpose described to you at the time the information was collected.

We may employ third-party companies and Individuals due to the following reasons:

  2. To provide service on our behalf

  4. To assist us in analyzing how our service is used

THIRD-PARTY EMBEDS

Pondr does not host some of the content displayed on our Services. Users have the ability to post content that is actually hosted by a third party, but is embedded in our pages (an “Embed”). When you interact with an Embed, it can send information about your interaction to the hosting third party just as if you were visiting the third party’s site directly. For example, when you load a Pondr post page with a YouTube video Embed and watch the video, YouTube receives information about your activity, such as your IP address and how much of the video you watch. Pondr does not control what information third parties collect through Embeds or what they do with the information. This Privacy Policy does not apply to information collected through Embeds. The privacy policy belonging to the third party hosting the Embed applies to any information the Embed collects, and we recommend you review that policy before interacting with the Embed. We are not responsible for the practices of such third parties, whose information practices are subject to their own policies and procedures, not to this Privacy Policy.


PROMOTE SAFETY, INTEGRITY AND SECURITY

We use the information we have to verify accounts and activity, combat harmful conduct, detect and prevent bad experiences, maintain the integrity of our Products, and promote safety and security on and off of Pondr. For example, we use data we have to investigate suspicious activity or violations of our terms or policies.


PROTECTION OF INFORMATION

The security of your information is important to us. Pondr has implemented safeguards to protect the information we collect. However, no website or Internet transmission is completely secure. We urge you to take steps to keep your personal information safe, such as choosing a strong password and keeping it private, as well as logging out of your user account on a shared or unsecured device.

  1. Access and amend your information: You may update or correct your account information at any time by logging in to your account. You may also make a number of other adjustments to settings or the display of information about you.
  2. Your Content: You may edit or delete your posts at any time. Any deleted content will be removed from third-party sites from which it has been shared via Pondr’s standard sharing features; however, we have no control over deletions or changes to your content
  3. Topics: You can change topics that you are affiliated with in your profile.
  4. Linked Networks: You may connect or disconnect your Linked Networks, such as Google, through the Account Settings tab in your profile settings, and you may access, amend and delete much of your profile information through your profile settings. Once you disconnect a Linked Network, we will not receive information from that Linked Network going forward unless you choose to reconnect it. You may also control whether the Linked Network is visible in your profile and, if you enable contact imports, how you message your contacts to find and connect with you on Pondr. if it has been shared manually by others.

CHILDREN’S PRIVACY

We do not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If we become aware that we have collected personal information from a child under the relevant age without parental consent, we take steps to delete that information. If you’re a parent or guardian and you are aware that your child has provided us with personal information, please contact us so that we can accordingly delete it from our servers.


DATA POLICY:

The California Consumer Privacy Act or “CCPA” (Cal. Civ. Code § 1798.100 et seq.) affords consumers residing in California certain rights with respect to their personal information. If you are a California resident, this section applies to you.

In the preceding 12 months, we have collected the following categories of personal information: identifiers, commercial information, internet or other electronic network activity information, and inferences. For details about the precise data points, we collect and the categories of sources of such collection, please see the Collection of Information section above. We collect personal information for the business and commercial purposes described in the Use of Information section above.

Under the CCPA, you have a right to request information about our collection, use, and disclosure of your personal information over the prior 12 months, and ask that we provide you with the following information:

  2. Categories of sources from which we collect personal information.

If we receive your request from an authorized agent, we may ask for evidence that you have provided such an agent with a power of attorney or that the agent otherwise has valid written authority to submit requests to exercise rights on your behalf. ADDITIONAL DISCLOSURES FOR USERS IN EUROPEAN ECONOMIC AREA

If you are located in the European Economic Area (“EEA”), the United Kingdom, or Switzerland, you have certain rights and protections under applicable law regarding the processing of your personal data, and this section applies to you.


Legal Basis for Processing

When we process your personal data, we will do so in reliance on the following lawful bases:

ADDITIONAL DISCLOSURES FOR USERS IN INDIA:

Indian law defines ‘sensitive personal information’ to mean information relating to: (i) passwords; (ii) financial information such as bank account/credit card/debit card details; (iii) physical, physiological and mental health condition; (iv) sexual orientation; (v) medical records and history; (vi) biometric information; (vii) any details relating to the above clauses as required for providing you with access to the Platform; and (viii) any of the information received under above clauses for processing, stored or processed under lawful contract or otherwise. Unless otherwise specified in the Privacy Policy, ‘personal information’ will include ‘sensitive personal information’ as well. By way of illustration, you will have provided us such consent by your conduct if you choose to share your personal information while using the Pondr, such as by including sensitive personal information in Your Content or by providing sensitive personal information in your registration information.

If an individual in India deletes or deactivates their account, then their personal information will be deleted as per requirements under applicable law.

While transferring personal information collected from individuals in India, we will ensure that it is transferred to entities that offer at least the same levels of data protection as adhered to by us.


Data Retention

We store personal data associated with your account for as long as your account remains active. If you close your account, we will delete your account data within 14 days. We store other personal data for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.


Data Subject Requests

Subject to certain limitations, you have the right to request access to the personal data we hold about you and to receive your data in a portable format, the right to ask that your personal data be corrected or erased, and the right to object to, or request that we restrict, certain processing.
